Nature of Employment. If I am hired by the Company, I agree that I will be an at-will employee, which means that either I or the Company may end my employment at any time, with or without cause or notice. I agree that no written materials or verbal statements by the Company will constitute an expressed or implied contract of continued employment and that this at-will relationship can only be modified in writing by the Company’s President.

Agreement to Arbitrate. Because of the delay and expense of the court systems, YUM and I agree to use confidential binding arbitration, instead of going to court, for any claims, including any claims now in existence or that may exist in the future (a) that I may have against YUM, its affiliates, and/or their current or former employees or (b) that YUM and/or its affiliates may have against me. Without limitation, such claims include any concerning wages, expense reimbursement, compensation, leave, employment (including, but not limited to, any claims concerning harassment, discrimination, or retaliation), conversion, breach of fiduciary duty, and/or termination of employment. This Agreement to Arbitrate shall be governed by the Federal Arbitration Act, 9 U.S.C.§ 1 et seq. Nothing in this Agreement to Arbitrate shall prohibit me from filing, participating in, or pursuing action with an administrative agency in accordance with applicable law, including the filing of charges or claims with the National Labor Relations Board or the Equal Employment Opportunity Commission, or the filing of a workers’ compensation claim or unemployment claim with an applicable state agency. In addition, nothing in this Agreement prohibits me or YUM from seeking emergency or temporary injunctive relief in a court of law in accordance with applicable law (however, after the court has issued a ruling concerning the emergency or temporary injunctive relief, YUM and I are required to submit the dispute to arbitration pursuant to this Agreement). In any arbitration, the then prevailing employment dispute resolution rules of the American Arbitration Association will apply, except that (a) YUM will pay the arbitrator’s fees; (b) if I am the one filing the claim, YUM will pay that portion of the arbitration filing fee in excess of the similar court filing fee had I gone to court; and (c) as discussed below, the arbitration shall occur only as an individual action and not as a class, collective, representative, or consolidated action. YUM and I agree that any and all claims subject to arbitration under this Agreement to Arbitrate may be instituted and arbitrated only in an individual capacity, and not on behalf of or as a part of any purported class, collective, representative, or consolidated action (collectively referred to in this Agreement to Arbitrate as a “Class Action”). Furthermore, YUM and I agree that neither party can initiate a Class Action in court or in arbitration in order to pursue any claims that are subject to arbitration under this Agreement to Arbitrate. Moreover, neither party can join a Class Action or participate as a member of a Class Action instituted by someone else in court or in arbitration in order to pursue any claims that are subject to arbitration under this Agreement to Arbitrate. It is the parties’ intent to the fullest extent permitted by law to waive any and all rights to the application of Class Action procedures or remedies with respect to all claims subject to this Agreement to Arbitrate. It is expressly agreed between YUM and me that any arbitrator adjudicating claims under this Agreement to Arbitrate shall have no power or authority to: (i) arbitrate any form of a Class Action; (ii) rule on the validity and enforceability of the waiver of Class Actions in this Agreement; or (iii) order, participate in or facilitate production of class-wide contact information or notification of others of potential claims. The waiver of Class Action claims and proceedings is an essential and material term of this Agreement to Arbitrate, and YUM and I agree that if it is determined that it is prohibited or invalid under applicable law, then this entire Agreement to Arbitrate is unenforceable. I acknowledge and agree that this Agreement to Arbitrate is made in exchange for my employment or continued employment, as well as the mutual promises contained in this Agreement. This Agreement to Arbitrate is not and shall not be construed to create any contract of employment, express or implied. This Agreement to Arbitrate does not in any way alter the “at will” status of employment with YUM, meaning that either I or YUM may terminate the employment relationship at any time, with or without advance notice, and with or without cause. This Agreement to Arbitrate supersedes any and all prior agreements to arbitrate entered into between me and YUM.

Authorization and Certification. I authorize the Company to investigate all information pertinent to my application in order to determine my qualifications for employment, which may include contacting former and/or current employers or any other person or entity. I am not a current user of illegal drugs, and I agree I will never work under the influence of drugs or alcohol. I authorize all persons and entities having information relevant to my application to provide that information to the Company. I understand that any offer of employment may be rescinded or my employment terminated if my references are inadequate or unacceptable to the Company. I certify and affirm that the information provided in connection with this application is true, accurate and complete, and that I have withheld nothing that would, if disclosed, affect this application unfavorably. 1. Collection of personal information by KFC

In applying for a position of employment at Kentucky Fried Chicken Pty Ltd (‘KFC”), you will be providing us with personal information; for example, your name, address, telephone number, email address and any other personal information contained on your resume.

2. The purpose of collecting your personal information

We collect this information in order to assess your application for employment. We may keep this information on file if your application is unsuccessful in case another suitable position becomes available.

If you withdraw your application for employment, your personal information will be permanently deleted.

This Privacy Notice tells you how KFC Europe Sàrl ("KFC", "we" or "us") processes your personal data when you apply for a position with KFC. It also describes your data protection rights, including a right to object to some of the processing which KFC carries out. We process the following types of personal data when you apply for a position with us.

Data you provide to us: We collect and store any data you provide us through your application on our recruitment portal, including your first and last name; contact details; email address and telephone number; your user account information; your application materials (CV, cover letter, current and/or previous work experience and affiliations including work address and location, education, qualifications and skills, and transcripts, and our notes from any interviews with you); your desired salary, job title role, type and location of employment sought and date available; your identification documents (passport number, national insurance number and/or government identification numbers where permitted, immigration status); your signature; and any other data you submit to us, including any correspondences you may have with us during the application process.

Data from other sources: We obtain data about you from other sources, including recruiters, employment research firms, identity verification services, the references you provide to us, websites and other publicly accessible data on the Internet. We may also receive data you submit to us through third-party websites. In certain countries, where permitted, we collect details of professional registrations, and sanctions with professional bodies, financial checks or criminal convictions where you have consented to background checks.

Information we collect automatically: When you make an application through our online portal, we may collect information sent to us by your computer, mobile phone or other access device. For example, this includes the pages you access, your computer IP address, device identifiers, the type of operating system you are using, your location, mobile network information, standard web log data and other information, your browser type and traffic to and from our site.

Sensitive Personal Data

We may also collect, store and use more sensitive types of personal information such as personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs; trade-union membership; genetic data, biometric data processed solely to identify a human being; health-related data; data concerning a person’s sex life or sexual orientation.

We will always explain why we are requesting this information and it is up to you whether you would like to provide it. We only process sensitive personal data in limited circumstances and in accordance with applicable privacy law.

Why We Collect, Use and Store this Personal Data

We collect, use and store your personal data for the reasons set out below:

Where this is necessary for KFC to review and assess your application for employment (prior to entering into a contract of employment with you).

This includes assessing your skills and interest in career opportunities at KFC, processing your application, analyzing your qualifications, verifying your identity and your eligibility for employment, and communicating with you about your application to respond to your inquiries and schedule interviews.

Where necessary for KFC's legitimate interests, as listed below, and where our interests are not overridden by your data protection rights.

Protecting our legitimate business interests. This includes, but is not limited to, making a decision about your recruitment or appointment and determining the terms on which you work for us.
Maintaining the security and integrity of our facilities, equipment and electronic platforms. This includes administering access rights, monitoring compliance with company protocols, and where permitted by local law and in accordance with relevant policies, for investigations and disciplinary actions.
Protecting our legal rights. This includes, but is not limited to, use in connection with legal claims, investigative and disciplinary purposes (including disclosure of personal data in connection with legal process or litigation).

Where necessary to comply with a legal obligation.

Disclosures to law enforcement agencies or in connection with legal claims, or regulatory purposes (including disclosure of such information in connection with legal process or litigation).
Compliance with any other legal, regulatory, auditing, enforcement, disciplinary, and ethics requirements, including but not limited to any ethics and compliance reporting requirements and compliance with court orders.

Relying on our legitimate interests

We have carried out balancing tests for all the data processing we carry out on the basis of our legitimate interests, which we have described above. You can obtain information on any of our balancing tests by contacting us using the details set out later in this notice.

How We Share Your Personal Data

We share some of your personal data with other members of the KFC and Yum! Brands group to administer and manage group functions or to refer you for other open positions where you have selected to join our Talent Pool (including with franchisees who may then contact you directly).

Your personal data will also be shared with companies providing services under contract to KFC, such as training providers, help desk providers and IT hosting and/or IT maintenance providers.

Personal data will also be shared with government authorities and/or law enforcement officials if required for the purposes above, if mandated by law or if required for the protection of our legitimate interests in compliance with applicable laws.

In the event that a KFC business is sold or integrated with another business (in part or whole), your details may be disclosed to our advisers and any prospective purchaser's adviser and will be passed to the new owners of the business / business unit.

Security

We maintain appropriate technical and organisational measures to protect against unauthorised or unlawful processing of your personal data and/or against accidental loss, alteration, disclosure or access, or accidental or unlawful destruction of or damage to your personal data. Where we engage third parties to process personal data, we select processors that provide adequate technical and organisational security measures. These measures are aimed at ensuring the ongoing integrity and confidentiality of your personal data.

Your Choices and Rights

You have the right to ask KFC for a copy of your personal data; to request that your personal data is corrected, deleted or that processing is restricted; and to obtain the personal data you provide in a structured, machine-readable format. In addition, you can object to the processing of your personal data in some circumstances (in particular, where we don’t have to process the data to meet a contractual or other legal requirement or compelling interest). Where we have asked for your consent, you may withdraw consent at any time. If you ask to withdraw your consent to KFC processing your data, this will not affect any processing which has already taken place at that time.

These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep. If you have unresolved concerns, you have the right to complain to the data protection authority in the country you reside, where you work or where we are located.

How long we keep your personal data

We will retain your personal data only for the duration of the recruitment process and, if you are unsuccessful or choose not to accept an employment offer, for a period of 12 months, unless we notify you of a different retention period, so that we can keep you in mind for future roles. If you accept employment with us, we will retain your personal data throughout your employment in accordance with a separate notice we provide to you upon your acceptance of employment.

International Transfers

Your personal data will be processed in or accessed from jurisdictions outside the European Economic Area ("EEA") and Switzerland by us and by some of the trusted third parties to whom we share your personal data as set out above. We rely on international data transfer mechanisms, such as European Commission-approved standard contractual clauses, to transfer your personal data to Yum! Brands, Inc. in the United States. When we transfer your data to organisations outside the KFC and Yum! Brands, Inc. group we use European Commission-approved standard contractual clauses to safeguard the transfer. Where we transfer personal data to a third party that has implemented Binding Corporate Rules, we may rely on them to safeguard the transfer.
